ADJUDICATION

What is Adjudication?

Adjudication is a contractual and statutory mechanism of dispute resolution used the construction industry.  It involves the reference of a dispute to a decision maker for determination within a normally a tight time limit.

 

It can be on documents only and in some cases it involves site visits and inspections where required. 

Since adjudication is a statutory process, parties to a construction contract cannot cannot contract out of it.  Is often described as a "pay first, argue later" mechanism for resolving disputes in the construction industry and is designed to protect cash-flow during construction.

 

Adjudication is appropriate for resolving claims relating to:

  • Interim payments;

  • Delay and disruption of the works;

  • Defects in the works; and

  • The final account.

Adjudicator's decision is binding unless appealed and overturned in court.
