What is Adjudication?

Adjudication is a statutory mechanism of dispute resolution used in the construction industry. It involves the reference of a dispute to a decision maker for determination within a tight time limit.

It can be on documents only, and in some cases it involves site visits and inspections where required.
​
Since adjudication is a statutory process, parties to a construction contract cannot contract out of it. It is often described as a "pay first, argue later" mechanism for resolving disputes in the construction industry, and is designed to protect cash-flow during construction.
​
Adjudication is appropriate for resolving claims relating to:

Interim payments;

Delay and disruption;
-
Defects; and
-
The final account.
​
Adjudicator's decision is binding unless appealed and overturned in court.
